Mykola Tomenko: Paid Services provoking Corruption in the Higher Education Establishments should be cancelled

 

 "Paid services provoking corruption in the higher education establishments should be cancelled," states the request to the President of Ukraine Viktor Yanukovych submitted by Mykola Tomenko, Deputy Chairman of The Verkhovna Rada of Ukraine, Yevhen Suslov and Valerii Dubil, People´s Deputies from the BYuT Faction, Valerii Baranov, member of the Lytvyn Bloc Faction, and Ruslan Kniazevych, member of Our Ukraine-People´s Self-Defence Faction.

 

The People´s Deputies stressed that introduction of paid services in the higher education establishments by the Decree of the Cabinet of Ministers of Ukraine No. 796 "On Ratification of the List of Paid Services to be rendered by the Education Establishments, other Institutions and Establishments of the Education System in the Public and Municipal Ownership" aroused doubts as to its legitimacy and compliance with the Constitution of Ukraine. They requested the President to cancel this Resolution.

 

"The Cabinet of Ministers authorized the state-owned education establishments to render paid services connected with the organization of the education process and envisaged by the curricula, which contravenes clause 53 of the Constitution of Ukraine that guarantees the right for education and declares that the State shall ensure accessible and free pre-school, complete general secondary, vocational and higher education at the state and communal educational establishments," the request reads.

 

The People´s Deputies remind that the Resolution of the Constitutional Court of Ukraine of March 4, 2004 No.5-рп/2004 on accessible and free education states that education is free as the constitution guarantees realization of the right of education, which presupposes possibility of education at the state and municipal education establishments without payment in any form for educational services on the level and in the scope fixed by the legislation, and within the limits of education that is free under part 3 of clause 53 of the Constitution of Ukraine.
